Welcome to Café Unido. The terms “we,” “us,” and “our” refer to Café Unido. Café Unido operates this website and online store, including all related information, content, features, tools, products, and services offered through the site (collectively, the “Services”).

Our online store is powered by Shopify, which provides the e-commerce platform that allows us to offer our products and Services to you.

These Terms of Service (“Terms”), together with our Privacy Policy, Refund Policy, Shipping Policy, and any other policies referenced herein, describe your rights and responsibilities when using our Services.

Please read these Terms carefully. By visiting, accessing, interacting with, or purchasing through our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.

SECTION 1 – ACCESS AND ACCOUNT

By using the Services, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you have provided consent for any minor dependents under your supervision to use the Services.

You may be required to provide information including your name, email address, billing information, payment information, and shipping address.

You represent and warrant that all information you provide is accurate, current, and complete and that you have the right to provide such information.

You are responsible for maintaining the confidentiality and security of your account credentials and for all activity occurring through your account.

SECTION 2 – OUR PRODUCTS

Café Unido specializes in coffee and related products.

We make reasonable efforts to accurately describe and display our products. However, coffee is a natural agricultural product and characteristics may vary between harvests, lots, origins, varieties, processing methods, and roast batches.

Flavor notes and tasting descriptions are intended to describe characteristics that may be experienced in the coffee and are not representations that every customer will perceive the same flavors.

The final flavor of brewed coffee may also be affected by variables including grind size, water quality, brewing equipment, brewing method, temperature, recipe, and preparation.

Product packaging, labels, colors, and appearance shown online may differ slightly from the product received.

All product descriptions, availability, pricing, and specifications are subject to change without notice.

We reserve the right to discontinue products or limit quantities available to any person, household, geographic region, or jurisdiction.

SECTION 3 – COFFEE FRESHNESS AND FINAL SALE

Coffee is a food product with a limited freshness and shelf life.

For food safety, quality control, freshness, and inventory integrity, all coffee sales are final and coffee cannot be returned or exchanged once it has been shipped or otherwise transferred to the customer.

This applies whether or not the coffee bag has been opened.

Exceptions may be made when:

  • The product arrives damaged;

  • The packaging is damaged or compromised;

  • The product is defective or unsuitable for consumption;

  • You receive a product different from the one ordered; or

  • Another fulfillment error occurred for which Café Unido is responsible.

Personal taste preference, brewing results, or a customer’s preference for another roast, origin, variety, or flavor profile do not constitute a product defect.

Any approved refund, replacement, or store credit will be handled in accordance with our Refund Policy.

Nothing in these Terms limits rights that cannot legally be waived under applicable consumer protection law.

SECTION 4 – ORDERS

When you place an order through our Services, you are making an offer to purchase the selected products.

Your order is not accepted until Café Unido confirms acceptance and successfully processes payment.

We reserve the right to reject, limit, modify, or cancel an order when reasonably necessary, including because of:

  • Product availability;

  • Pricing or product information errors;

  • Suspected fraud or unauthorized transactions;

  • Shipping restrictions;

  • Quantity limitations; or

  • Circumstances outside our reasonable control.

If we cancel an order after payment has been collected, we will refund the applicable amount.

Please review your order carefully before submitting it. Because coffee may be roasted, packed, or prepared specifically to fulfill orders, we may be unable to modify or cancel an order once processing has begun.

Purchases are subject to our Refund Policy.

SECTION 5 – PRICES AND PAYMENT

Prices, promotions, discounts, and product availability are subject to change without notice.

The price charged will generally be the price displayed at the time your order is submitted, subject to correction of obvious pricing or technical errors.

Unless otherwise stated, displayed prices may not include applicable taxes, shipping costs, customs duties, import fees, or similar charges.

You agree to provide current, complete, and accurate billing and payment information.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us and our payment providers to charge the applicable purchase amount.

Promotional offers may be subject to additional terms and conditions. If the terms of a specific promotion conflict with these Terms, the promotion-specific terms will govern with respect to that promotion.

SECTION 6 – SHIPPING AND DELIVERY

Shipping and delivery dates provided through the Services are estimates unless expressly stated otherwise.

We are not responsible for delays caused by carriers, customs authorities, weather, governmental actions, incorrect customer-provided shipping information, or circumstances outside our reasonable control.

Customers are responsible for providing an accurate and complete delivery address.

If your shipment arrives damaged, contains an incorrect product, or appears to have been compromised during shipping, please contact info@cafeunido.com as soon as possible.

We may request photographs of the shipping box, coffee packaging, shipping label, and affected product in order to evaluate a claim.

Lost, damaged, or incorrect shipments will be handled in accordance with our Refund Policy and applicable law.

International customers are responsible for any applicable customs duties, taxes, import fees, or governmental charges unless otherwise expressly stated at checkout.

SECTION 7 – INTELLECTUAL PROPERTY

The Services and their content, including trademarks, logos, brand names, product names, photographs, graphics, illustrations, packaging designs, videos, text, product descriptions, website design, and other materials, are owned by or licensed to Café Unido and are protected by applicable intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial purposes.

Unless we provide prior written authorization, you may not reproduce, distribute, modify, republish, sell, license, publicly display, commercially exploit, or create derivative works from any material contained in the Services.

“Café Unido,” its logos, product names, designs, packaging, and slogans are trademarks or intellectual property of Café Unido or its applicable affiliates or licensors.

All rights not expressly granted are reserved.

SECTION 8 – OPTIONAL AND THIRD-PARTY TOOLS

We may provide access to tools, integrations, payment services, applications, or functionality operated by third parties.

We do not necessarily monitor or control these third-party tools.

Unless otherwise expressly stated, third-party tools are provided on an “as is” and “as available” basis and your use of them may also be governed by the third party’s own terms and privacy policies.

We are not responsible for the operation of third-party services except to the extent required by applicable law.

We are not responsible for the content, accuracy, security, products, services, privacy practices, or business practices of third-party websites.

SECTION 10 – RELATIONSHIP WITH SHOPIFY

Café Unido's online store is powered by Shopify.

However, purchases you make from our store are transactions directly between you and Café Unido.

Shopify provides technology and services that enable us to operate our online store but is not the seller of Café Unido products.

Your use of Shopify-related functionality may also be subject to Shopify's applicable policies and terms.

SECTION 11 – PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our online store is powered by Shopify and may use additional service providers, information may be processed by Shopify and other third parties that assist us in providing our Services, processing payments, fulfilling orders, providing customer service, preventing fraud, and operating our business.

SECTION 12 – REVIEWS, COMMENTS AND FEEDBACK

If you submit reviews, photographs, suggestions, ideas, comments, or other content to us (“Feedback”), you represent that you have the necessary rights to provide that Feedback.

Unless otherwise prohibited by law, you grant Café Unido a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, publish, display, adapt, and distribute Feedback in connection with our business and marketing.

  • Is unlawful, threatening, abusive, defamatory, obscene, or otherwise prohibited by law;

We reserve the right, but have no obligation, to remove content that violates these Terms.

Occasionally, information on our Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, availability, promotions, shipping charges, transit times, or other information.

SECTION 18 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CAFÉ UNIDO AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES.

THIS INCLUDES, TO THE EXTENT PERMITTED BY LAW, LOSS OF PROFITS, REVENUE, SAVINGS, DATA, OR BUSINESS OPPORTUNITIES.

Nothing in these Terms limits or excludes liability where doing so would be prohibited by applicable law, including liability arising from rights or protections that cannot legally be waived.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Café Unido and its affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, damages, liabilities, and reasonable costs arising from:

  4. Your unlawful or unauthorized use of the Services.

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law or, where necessary, severed from these Terms.

The remaining provisions will continue in full force and effect.
